Form FNS-7 "Destination Data for Delivery of Donated Foods" is to be used for reporting in conjunction with FNS Instruction 709-5.  

FNS requires that inventories do not exceed a six-month supply of any USDA Foods without approval from FNS. Per 7 CFR 250.17(a), state agencies administering TEFAP are required to use Form FNS-155, Inventory Management Register, to report any food items in state and state-contracted warehouses that exceed six months of inventory.

USDA intends to use all available program flexibilities and contingencies to serve our program participants across our 15 nutrition programs. We have already begun to issue waivers to ease program operations and protect the health of participants.

 On August 26, FNS delivered a live webinar to state agencies and local program operators providing an overview of nationwide waivers for school year 2021-22. During the webinar, staff discussed scenarios where flexibilities may be utilized and suggestions for planning for the unexpected.  Lastly, resources were shared to further help state agencies and local program operators meet the unique needs of their community. 

This document contains a correction to an interim final rule published in the Federal Register on Aug.  13, 2021. The rule codifies statutory requirements enacted by the Agriculture Improvement Act of 2018. This document also extends the comment period for the interim final rule.
