This memorandum clarifies the requirements and options for school food authorities acting as a collective unit in performing activities relating to donated foods. It also clarifies the requirements for the distributing agency with respect to such SFAs.
This policy memorandum is the result of activities undertaken to plan a government-wide response to a potential human pandemic and addresses the operation of its USDA food programs during a major pandemic event.
The purpose of this policy memorandum is to clarify the responsibilities of the state administering agency and the state distributing agency with respect to ensuring compliance with requirements for donated foods in the National School Lunch Program, the Summer Food Service Program and the Child and Adult Care Food Program.
During a Presidentially declared disaster/emergency, or during a situation of distress declared by a state or FNS, the state may find it necessary to transport USDA Foods from one area within the state to another in support of disaster feeding efforts. These intra-state transportation costs will be reimbursed by FNS during a Presidentially declared disaster/emergency, and reimbursed by FNS to the extent funds are available during situations of distress.

In this memorandum, we present several options for consideration by the distributing agency to help ensure that service institutions receive donated foods for use in the summer meals provided in SFSP in an efficient and cost-effective manner.
A number of schools nationwide are still having difficulty obtaining the two food safety inspections required by the Child Nutrition and WIC Reauthorization Act of 2004. Although FNS realizes that many of the difficulties schools face are beyond their control, we would like to stress that local program operators are responsible for requesting the food safety inspections from the public health department and documenting their efforts.
This memo clarifies how the food safety inspection requirement is to be carried out by program operators on military bases, Indian reservations and Residential Child Care Institutions (RCCIs).
Please note that on May 14, 2007, FNS issued the attached Federal Register notice announcing a correction in the national average value of donated foods or, where applicable, cash in lieu of donated foods for school year 2007, which began on July 1, 2006 and runs through June 30, 2007.
This memorandum addresses the eligibility of privately owned or managed adult correctional institutions to receive donated foods for their own use, as charitable institutions, or to receive and use donated foods to provide meals for another charitable institution’s food service.
