Attached is guidance for FNS regional offices and state agencies on the Simplified Summer Food Program.
Recently, we received an inquiry on behalf of a food service management company (FSMC). The inquiry asked whether the OMB cost principles were relevant to the food acquisition costs borne by a FSMC charging a school food authority a fixed price per meal for the reimbursable meals and contractually agreed upon meal equivalents served under the contract.
FNS published an interim rule, “Child and Adult Care Food Program; Improving Management and Program Integrity" that explains a provision in that rule requiring state agencies that administer the CACFP to share information with state agencies that administer the Food Stamp Program
The Child Nutrition and WIC Reauthorization Act of 2004 amended sections of the Richard B. Russell National School Lunch Act affecting the eligibility determination process for free and reduced price benefits under the National School Lunch Program, School Breakfast Program and the Special Milk Program for Children.
This memorandum is in response to questions raised by the Connecticut state agency.
We are issuing policy that will allow states to consider the information contained in an Upward Bound participant’s application to be equivalent to that of the Summer Food Service Program meal application when making eligibility determinations to participant in the SFSP.
Questions have arisen regarding the eligibility for reimbursement of meals served to children who are placed by a public school district in special schools or institutions which are either not eligible to participate or choose not to participate in the NSLP and/or SBP.
Provision 2 requires that the school serve meals to participating children at no charge but reduces application burdens to once every 4 years and simplifies meal counting and claiming procedures by allowing a school to receive meal reimbursement based on claiming percentages.
This memorandum extends this categorical eligibility provision to the National School Lunch Program, the School Breakfast Program, the Special Milk Program for Children, and closed enrolled sites in the Summer Food Service Program.
FNS published the subject interim regulation, and established the effective date as Dec. 15, 1999, because the customary effective date for regulations is 30 days after publication and given the health and reimbursement implications, we wished to implement the regulation as soon as possible.
