FNS has used its authority under FFRCA to waive certain onsite monitoring requirements for the school meals programs, the Child and Adult Care Food Program, and the Summer Food Service Program, so that programs can to maintain program integrity and support social distancing while providing meals.

This study is the first nationally representative, comprehensive assessment of the school meal programs since the updated nutrition standards for school meals were phased in beginning school year 2012-2013. This guide consolidates and underscores FNS policy concerning waivers of the ABAWD time limit and replaces its predecessor, FNS' December 2016 Guide to Supporting Requests to Waive the Time Limit for Able-Bodied Adults without Dependents (ABAWD). FNS advises state agencies to use this guide to understand, obtain, and prepare evidence that successfully supports an ABAWD time limit waiver request based on relevant sections of the Act; federal regulations; and historical SNAP policy.
The Richard B Russell National School Lunch Act (NSLA) allows the use of school data to establish area eligibility in the Child and Adult Care Food Program and the Summer Food Service Program. The NSLA also allows the use of census data to establish tier I eligibility for CACFP day care homes and area eligibility for SFSP sites.
FNS has heard from state agency partners that a safe and successful return to normal operations will require more than 30 days’ notice once the nationally-declared public health emergency ends. Therefore, this memorandum extends certain WIC waivers until 90 days after the end of the nationally-declared public health emergency under the Public Health Service Act.
FNS requires that inventories do not exceed a six-month supply of any USDA Foods without approval from FNS. Per 7 CFR 250.17(a), state agencies administering TEFAP are required to use Form FNS-155, Inventory Management Register, to report any food items in state and state-contracted warehouses that exceed six months of inventory.
