This memorandum provides guidance to help states prepare to implement the SNAP time limit for able-bodied adults without dependents (ABAWDs) once the temporary and partial suspension under the Family First Coronavirus Act (FFCRA) lapses. FNS has heard from state agency partners that a safe and successful return to normal operations will require more than 30 days’ notice once the nationally-declared public health emergency ends. Therefore, this memorandum extends certain WIC waivers until 90 days after the end of the nationally-declared public health emergency under the Public Health Service Act.
FNS is waiving the requirement that the state agency annually review a number of sponsors whose program reimbursements, in the aggregate, account for at least one-half of the total program reimbursements in the state in the previous year.
FNS is granting a waiver of certain fiscal action requirements in the National School Lunch Program and the School Breakfast Program. This waiver is available for any state where there is a supply chain disruption with respect to foods served under such a qualified program and such disruption is due to COVID–19.
FNS waives, for all states, the requirements to serve meals that meet specified meal pattern requirements during the public health emergency due to COVID–19.
