On Nov. 19, 2009, the Program Development Division issued guidance on how to implement Section 8 of that act requiring state agencies to exclude the $25 a week increased unemployment compensation payments from all calculation of resources and income.

This memorandum clarifies FNS regulations and policies regarding the allowability of requiring payment and soliciting contributions (i.e., "payments" or "pay") in exchange for foods from FNS program participants.

Per CSFP regulations, participants are prohibited from receiving CSFP benefits and WIC benefits at the same time. The American Recovery and Reinvestment Act of 2009 suspends restrictions on Able Bodied Adults Without Dependent participation in SNAP as of April 1, 2009 continuing through Sept. 30, 2010, unless state agencies choose to impose specific work requirements.

The recently-enacted Unemployment Compensation Extension Act of 2008 modified the criteria used by the Department of Labor for the extended benefits program for the duration of the legislation. As a result, some states qualify for the EB program based on the recently-revised criteria rather than the traditional criteria.
