The Consolidated Appropriations Act 2023 authorized a permanent, nationwide Summer EBT program beginning in 2024. The Act requires FNS to promulgate interim regulations within a year of the Act’s enactment. Interim regulations are effective upon publication and FNS will accept comments on the interim rule to inform subsequent rulemakings.
This memorandum provides guidance to SNAP state agencies on the end of the temporary student exemptions as described in Section 702(e) of the Consolidated Appropriations Act, 2021 (CAA). This policy memorandum transmits the Civil Monetary Penalty (CMP) inflation adjustment for 2021 for the Special Supplemental Nutrition Program for Women, Infants, and Children (WIC). The adjustment was published in the Federal Register as part of the Civil Monetary Penalty Inflation Adjustments for 2021 Final Rule published on May 10, 2021, at 86 FR 24699.
Any firm may request administrative and judicial review, if it is aggrieved by any of the actions described in SNAP regulations. The Administrative Review Branch ensures that FNS follows the provisions of the Food and Nutrition Act, SNAP regulations, and agency retailer policy, and that the agency's administrative actions are equitable and consistent.
FNS is establishing a nationwide waiver to support schools unable to complete a triennial assessment of the local school wellness policies by June 30, 2020, due to school closures as a result of COVID–19. This waiver applies to state agencies that have local educational agencies administering the NSLP and/or SBP.
Local educational agencies participating in the National School Lunch Program and/or School Breakfast Program are required to develop a local school wellness policy that promotes the health of students and addresses the problem of childhood obesity.

This memorandum provides information on the new requirements for local wellness policies so that local educational agencies can begin reviewing their policies for the coming school year 2011-12, and begin moving forward on implementing the new requirements.
In Section 204 of the Child Nutrition and WIC Reauthorization Act, each local educational agency participating in a program authorized by the Richard B. Russell National School Lunch Act or the Child Nutrition Act of 1966 is required to establish a local wellness policy for schools under the LEA, not later than the first day of the school year beginning after June 30, 2006.
