This memorandum and attachment provide information on the release of the revised Federal-State Agreement for Child Nutrition and Food Distribution Programs, form FNS-74. This agreement between FNS and state agencies is used to set out the requirements for administering the child nutrition programs per 7 CFR 235.3(b).
On September 30, 2016, USDA’s Food and Nutrition Service issued new guidance describing the federal requirements state agencies and school food authorities must comply with in the National School Lunch and School Breakfast Programs, with respect to indirect costs. The purpose of this policy memorandum is to provide further guidance and clarity on new donated food insurance requirements for state distributing agencies, subdistributing agencies, select commercial storage facilities, and recipient agencies that have agreements with the state distributing agency or subdistributing agency to store and distribute donated foods.

The revised policy memo requires supplemental reporting from processors and requires state verification of credits provided by the processor to the SFA. Processors wishing to continue participation in the pilot will have to sign the attached revised NPA amendment to extend their participation in the pilot.
