The attached questions and answers are intended to address state agency concerns regarding the Implementing Memorandum for Section 4006, "Standard Utility Allowances Based on the Receipt of Energy Assistance," of the Agricultural Act of 2014.
FNS has recently undertaken a review of its waiver processes and the effectiveness of its approved waivers. Specifically, FNS has recently reviewed the "Early Denial" waiver, also known as "10-Day Denial" waiver, which waives Supplemental Nutrition Assistance Program (SNAP) regulations at 7 CFR 273.2(g)(3) and 7 CFR 273.2(h)(2).
Section 4 of the Richard B. Russell National School Lunch Act provides general cash for food assistance payments to states to assist schools in purchasing food. The NSLA provides two different section 4 payment levels for lunches served under the NSLP.
