In an effort to reduce fraud, waste and abuse, we are issuing this memorandum to clarify SNAP Electronic Benefits Transfer expungement policy. States are strongly encouraged to expunge benefit allotments nine months after issuance, regardless of the household’s SNAP activity, in accordance with regulatory requirements.

This memo provides answers to follow-up questions submitted by state agencies on the variance exclusion period for implementation of Section 10102: Modifications to SNAP Work Requirements for Able-Bodied Adults and Section 10103: Availability of Standard Utility Allowances Based on Receipt of Energy Assistance.

This memorandum provides state agencies with additional information on implementing Section 10102(b) and (c) of the OBBB, which changes criteria for waivers of the Able-Bodied Adults Without Dependents (ABAWD) time limit with special provisions for Alaska and Hawaii. Please note, we are reviewing SNAP regulations pertaining to ABAWD waiver requirements following enactment of the OBBB to determine changes necessary to comply with the changes.

Because there is no longer authority for ABAWD waivers based on a lack of sufficient jobs, we will terminate all remaining such waivers 30 days from the issuance of this letter.

We are committed to supporting WIC state agency efforts to combat vendor fraud, waste and abuse. State agencies should make every effort to increase oversight of WIC vendors through the strategies outlined in this memo.
