The purpose of this memorandum is to clarify that migrant sites participating in the Summer Food Service Program (SFSP) are considered area eligible sites falling under the category of open, or restricted open, sites as defined by SFSP regulations, 7 CFR 225.2.

Although the eligibility of migrant sites is conditioned upon a determination that the site predominantly serves the children of migrant workers, the site is not an enrolled site. This distinction is important because area eligible sites, unlike enrolled sites, may participate in the SFSP for the duration of the program year for which their eligibility has been established without further or additional determination. Open and open restricted sites determined to be eligible based on information from migrant organizations are subject to annual redetermination.
