This memorandum is intended to clarify FNS policy regarding men who are victims of domestic violence residing in shelters for battered women and children, which will henceforth be referred to as shelters for battered persons. Both the Food and Nutrition Act of 2008, as amended (the Act), and SNAP regulations allow certain flexibilities for victims of domestic violence who are fleeing their abuser.

Due to the increase in the number of states with laws that permit the use of marijuana for medicinal purposes, FNS is now reaffirming its long standing policy that a household may not utilize the SNAP medical deduction for the cost of any substance considered illegal under federal law.

This memo provides information about which states are eligible to waive Able Bodied Adults Without Dependents (ABAWD) time limits for participation in the Supplemental Nutrition Assistance Program(SNAP) for fiscal year 2013.  Under  SNAP regulations at 7CFR 273.24(f)(2), a state can qualify for a 12-month statewide ABAWD waiver if the Department of Labor's Unemployment Insurance Service determines it meets the criteria for extended unemployment benefits.
