This collection is a revision of a currently approved collection for state administrative expense funds expended in the operation of the child nutrition programs administered under the Child Nutrition Act of 1966.
This notice sets forth the interpretation that the U.S. Department of Agriculture uses for the term “Federal public benefit” as used in Title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996. In doing so, this notice supersedes any prior interpretation in any notice or other document issued by any USDA agency. This notice also describes and preliminarily identifies the USDA programs that provide “Federal public benefits” within the scope of PRWORA.
The purpose of this memorandum is to remind schools, sponsors, and institutions participating in any USDA Child Nutrition Program, including the National School Lunch Program, School Breakfast Program, Fresh Fruit and Vegetable Program, Special Milk Program for Children , Child and Adult Care Food Program, Summer Food Service Program, and the Seamless Summer Option , of the many ways they can purchase local foods to serve in program meals.

This final rule makes improvements in USDA’s food distribution programs.
Guidance for FDPIR administering agencies on reporting retroactive issuances of partial and full food packages to participants on the FNS-152 during the ongoing warehouse delivery delays.
Guidance for FDPIR administering agency staff to request administrative funding to support additional administrative costs associated with the national warehouse response.
Guidance for FDPIR and CSFP agency staff related to reimbursement of expenses associated with delivered out-of-condition USDA Foods.
Guidance for FDPIR and CSFP agencies on (1) receiving USDA Foods from contracted national multi-food warehouses and/or as direct shipments from a vendor, and (2) reporting complaints related to USDA Food deliveries.
This letter is to inform Indian Tribal Organizations and state agencies operating FDPIR of the opportunity to receive funding, in the form of direct cash assistance, for the purchase of domestically grown and produced foods.
The purpose of this memorandum is to provide clarification on the written notice requirements that apply to indian tribal organizations and state agencies that administer FDPIR, per the USDA regulations on equal opportunity for religious organizations to participate in USDA assistance programs.
