The Healthy, Hunger-Free Kids Act of 2010 (the Act), PL 111-296, clarifies requirements for participation in evaluations and research in the child nutrition programs. The purpose of this memorandum is to provide guidance on the implementation of this provision.

Section 305 of the Act amends section 28 of the Richard B. Russell National School Lunch Act (NSLA) (42 USC 1769i) to clarify that state agencies, local educational agencies, schools, institutions, facilities and contractors participating in the child nutrition programs authorized under the NSLA and Child Nutrition Act of 1966 are required to cooperate with the Department of Agriculture officials and contractors conducting evaluations and research.

State agencies should direct any questions concerning this guidance to the appropriate Food and Nutrition Service regional office. Regional offices with questions should contact the Child Nutrition Division.
