The Healthy, Hunger-Free Kids Act of 2010 (PL 111-296) was enacted on Dec. 13, 2010. Among other things, this law expanded the availability for reimbursement of at-risk afterschool meals to Child and Adult Care Food Program (CACFP) participants in all states.

On Dec. 17, 2010, Food and Nutrition Service issued implementation guidance (CACFP 04-2011, Child Nutrition Reauthorization 2010: Nationwide Expansion of At Risk Afterschool Meals in the Child and Adult Care Food Program). This memorandum is follow-up to that guidance and consolidates and updates our previous guidance relating to the at-risk afterschool meals component of CACFP. Therefore, this memorandum supersedes the following memoranda as they pertain to the at-risk afterschool meals component of CACFP:

  • Afterschool Snacks in the National School Lunch Program and the At-Risk Component of the Child and Adult Care Food Program, Edition 1, 2/17/1999;
  • Afterschool Snacks in the National School Lunch Program and the At-Risk Component of the Child and Adult Care Food Program, Edition 2, 4/9/1999; and
  • Afterschool Snacks in the National School Lunch Program and the At-Risk Component of the Child and Adult Care Food Program, Edition 3, 12/01/1999.

In this memorandum, at-risk afterschool “meals” refers to both meals and snacks. State agencies should direct any questions concerning this guidance to the appropriate FNS regional office.
