The purpose of this memorandum is to share a letter from the United States Department of Education to Chief State School Officers regarding the applicability of the Family Educational Rights and Privacy Act (FERPA) to the disclosure of personally identifiable information (PII) for students’ education records to facilitate the automatic enrollment of eligible children in the Summer Electronic Benefits Transfer for Children (Summer EBT) Program. The letter is available on the U.S. Department of Education’s website.
Regional offices are reminded to distribute this information to state agencies immediately. State agencies should direct questions to the appropriate FNS regional office.
