This rule proposes to amend Food Stamp Program regulations to implement a provision contained in the Mickey Leland Memorial Domestic Hunger Relief Act of 1990 (the Leland Act) to expand the criteria by which a resource can be considered inaccessible.

The Department originally published a proposed rule concerning this provision on Aug. 13, 1991 at 56 FR 40164. After reviewing the comments received, the Department elected to withdraw the provision as originally proposed and amend its proposal. Subsequently, on Dec. 13, 1991, the Food Stamp Act of 1977 was amended by the Food, Agriculture, Conservation, and Trade Act Amendments of 1991 which refined the Leland Act provision concerning inaccessible resources. In this proposed rulemaking, the Department is addressing both statutory provisions dealing with inaccessible resources.
