USDA has rescinded the Biden Administration’s May 2022 Bostock policy update that sought to require federally-funded food and nutrition service programs to redefine discrimination by reason of “sex” under Title IX of the Education Amendments of 1972 (Title IX) and the Food and Nutrition Act of 2008 as not based on just male or female, but also “gender identity.” Today’s guidance eliminates the illegal threats issued under the Biden Administration that mandated compliance with ever-evolving concepts of gender ideology as a condition for participation in USDA school programs.
This data collection fulfills states' reporting requirements and describes trends in program participation during the COVID-19 pandemic from July 2021 through September 2022. It is part of an ongoing study series examining child nutrition program operations, repurposed to collect waiver usage and trends in program participation and operations during the pandemic.
The third annual survey of School Food Authorities found that 95 percent of SFAs faced supply-chain related challenges in school year (SY) 2023-24, but that the number of reported challenges and impacts they have on school food service have largely declined compared to SY 2022-23. The Community Eligibility Provision is a National School Lunch Program and School Breakfast Program meal service option that allows schools and school districts located in high poverty areas to offer breakfast and lunch at no cost to all enrolled students.

A final rule, Child Nutrition Programs: Community Eligibility Provision-Increasing Options for Schools (88 FR 65778), was published on Sept. 26, 2023, with an effective date of Oct. 26, 2023, that established the 25 percent minimum ISP threshold. As a result, more students, households, and schools have the opportunity to experience CEP’s benefits, such as increasing access to school meals at no cost, eliminating unpaid meal charges, minimizing stigma, and streamlining meal service operations.
