This letter serves as notice to all WIC state agencies that effective Sept. 20, 2024, the Secretary of Agriculture has reaffirmed that a Supply Chain Disruption, as defined in 42 USC 1786(b)(24) and 7 CFR 246.2, exists in WIC state agencies with Gerber infant formula contracts. The contracted infant formula manufacturer, Gerber, has previously notified state agencies about the discontinuation and/or continued limited availability of the following contract brand formulas:

  • Gerber Good Start Soy powder and liquid concentrate formula (discontinued/limited availability)
  • Gerber Good Start SoothePro powder infant formula (limited availability)
  • Gerber Good Start Gentle powder infant formula (limited availability)

State agencies under contract with Gerber may experience significant impacts on the ability of participants to obtain the above contract brand infant formulas, creating the supply chain disruption at issue.

Pursuant to the authority granted under 42 USC 1786(s) and 7 CFR 246.29(b)(2)(ii), FNS will consider waiver requests from affected state agencies. This supply chain disruption is in place through Sept. 30, 2024.
