The purpose of this policy memorandum is to provide clarification that FDPIR meets the regulatory requirements as an automatic income eligibility program for purposes of WIC program income determination.

Section 246.7(d)(2)(vi)(B) of the WIC program regulations states that the state agency may accept, as evidence of income within program guidelines, documentation of the applicant's participation in state-administered programs provided that those programs have income eligibility guidelines at or below the state agency's program income guidelines.

State-administered program means any assistance program administered by an agency which uses either state funds, federal funds, or a combination of funding sources to provide benefits/services to individuals, including the WIC population.

The FDPIR provides an alternative to the Food Stamp Program for households on Indian reservations and low-income Indian households living near reservations. For WIC income determination purposes, an applicant participating in the FDPIR may be deemed automatically income eligible for WIC.
