This memorandum revises and replaces WIC Policy Memorandum #2000-2, Use of Banked Human Breast Milk in the WIC Program, issued Feb. 28, 2000.

This letter is in response to the impact of a destructive tornado that hit Mount Vernon, Indiana on July 9, 2024, causing substantial damage to a Mead Johnson distribution center.

This letter serves as notice to all WIC State agencies that effective July 18, 2024, the Secretary of Agriculture has declared that a supply chain disruption exists in areas served by WIC state agencies with Mead Johnson infant formula contracts.

This letter serves as notice to all WIC state agencies that effective June 21, 2024, the Secretary has reaffirmed that a supply chain disruption exists with Gerber infant formula contracts. 

In July of 2022, the Access to Baby Formula Act of 2022 was signed into law. This rule implements the provisions of ABFA and several other related changes to strengthen WIC’s ability to address certain disasters, emergencies, and supply chain disruptions, particularly those impacting infant formula.

This memorandum provides guidance to state agencies and local program operators on the use of infant formulas imported as part of the Food and Drug Administration’s 2022 Infant Formula Enforcement Discretion Policy.

The purpose of this memorandum is to ensure that all stakeholders are aware of the federal regulatory requirements related to the disclosure of confidential WIC vendor and participant information.

In the event of a Presidential Disaster Declaration, FNS can procure and provide an emergency supply of infant formula and food to supplement a state’s or FEMA's disaster feeding efforts.
