This collection is a revision of a currently approved collection. This information collection announces the intent of the Food and Nutrition Service to revise and report on the activities associated with the replacement of multiple Supplemental Nutrition Assistance Program Electronic Benefit Transfer cards, as well as the monitoring and notices associated with excessive requests for replacement SNAP EBT cards.
Pursuant to the provisions of the Privacy Act of 1974 and Office of Management and Budget (OMB) Circular No. A-108, notice is hereby given that the United States Department of Agriculture (USDA) proposes to create a new system of records (SOR) entitled USDA/FNS-15, “National Supplemental Nutrition Assistance Program (SNAP) Information Database.”
This interim final rule requires SNAP state agencies to provide information to the National Accuracy Clearinghouse (NAC) regarding individuals receiving SNAP benefits in their states in order to ensure they are not already receiving benefits in another state.
FNS is issuing this affirmation of a final rule, without change, of an interim rule that amended SNAP regulations, to require state agencies to monitor electronic benefit transfer card replacement requests and send notices to those clients who have requested four cards within a 12-month period.
In February, 2013, FNS published final regulations revising the definition of trafficking. It subsequently came to our attention that some states were not clear that upon its effective date, federal law takes precedence and states were expected to implement the new federal trafficking definition.
FNS is issuing a final rule to amend Supplemental Nutrition Assistance Program regulations to allow state agencies to deny a request for a replacement card until contact is made by the household with the state agency, if the requests for replacement cards are determined to be excessive.

This memorandum is to reiterate and clarify current policy governing intentional program violations as set forth in the Food Stamp Program regulations.
After a further review of this matter, and upon advice of our legal counsel, we have reconsidered our position on the use of the Request for Contact (RFC) to facilitate household cooperation with fraud investigations. We have decided that the RFC may only be issued by state eligibility workers and only when the state agency learns of a change in the household’s circumstances that calls into question the household’s continued eligibility for the program or its current level of benefits.
This rule finalizes the proposed rule of the same name which was published Dec. 17, 1999. It implements 13 provisions of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996.
